Hollis Artspace LLC Terms and Conditions & Liability Waiver


1. Aims:
Hollis Artspace aims to provide a fun and informative enrichment activities for youth and adults to learn more about art and work on various art activities. Students are expected to treat other students, staff, materials and the building with respect.

2. Sickness Please let Hollis Artspace know of any condition or health problem for participants. Please do not attend a class (adult) or send a child to Hollis Artspace classes if they are experiencing a fever, vomiting, coughing, running nose, sore throat or are otherwise unwell.

3. Covid Precautions:  At this point (Summer 2023), masks are optional. We aim to keep fans on and air flow moving in the classrooms.

4. Missed classes, cancellations and weather closings:

Hollis Artspace does not offer make-up classes for students who need to miss a class.

During the registration period, Hollis Artspace may cancel classes due to low enrollment. We may try to shift students into similar classes or issue a refund. Students will be notified at least 48 hours prior to the class start date if their class in under-enrolled.

In the event of closure due to severe weather – please check our Facebook page and website. In general, Hollis Artspace will cancel classes when Hollis schools are cancelled.  In most cases, a make up class can be arranged. If a make up class can not be scheduled,  a refund may be issued. Please write info@hollisartspace.com with any questions or concerns.

5. Payments/ Refunds:

All sales are final. Full payment is expected at the time of booking a class or workshop. 

For the regular school year (Sept- early June), classes & workshops: Refunds can be given (less a 5% credit card processing fee) if cancelled at least 72 hours before a scheduled class or workshop.

SUMMER WEEK LONG PROGRAMS: Payment is expected at time of booking (Upon request, Hollis Artspace can issue full refunds until May 15, 50 % refunds up to June 1, and no refunds after June 1. Extenuating circumstances taken on a case by case basis. Email info@hollisartspace.com with questions.

6. Accessibility:

The front entrance of the Artspace is accessible. The two main art classrooms are the second floor, and only accessible via stairs. Please let us know in advance if the student has limited mobility and we can discuss accommodations, including relocating the class to a more accessible space. 7. Student Info: Allergies, Emotional/ Behavioral Needs

If students have any sensitivities, allergies or other limitations or emotional needs, please let us know. If students have a one-on-one paraprofessional at school, please let us know as they may need extra support in the art class, which must be provided by the family. 

6. Student Behavior

Behavior Policy

Students shall behave with respect for other students, staff and the property.  In the event that a student’s behavior is determined by Hollis Artspace, in our sole discretion, to be detrimental to the program, including causing or potentially causing harm to themselves, our staff, other students or our property, Hollis Artspace has the right to end the student’s participation in the program.

Zero Tolerance Violations

Students may be subject to immediate expulsion from any Studio Art Program for the following reasons:

·       Physically harming or assaulting an individual

·       Using threats, harassment, intimidation, coercion, fear, or other comparable conduct toward anyone or urging other students to engage in such conduct with the intent to cause bodily harm

·       Bullying, emotional abuse, sexual harassment, stalking

·       Disrespectful behavior and harassment based upon an individual's sex, race, ethnicity, national origin, age, religion or any other legally protected characteristics will not be tolerated

·       Defacing or destroying personal property

·       Defacing or destroying the property of Hollis Artspace

·       Possession, controlling, or transferring a weapon or any other dangerous devices

·       Exhibiting other behaviors which may endanger the health and safety of others

1.     MEDICAL Consent to First aid

Hollis Artspace LLC will attempt to contact the emergency contact listed on your registration form prior to administering first aid or offering other medical assistance, unless Hollis Artspace LLC determines in good faith that an injury is life threatening.

In the event that the emergency contact cannot be reached, I hereby consent to the student receiving medical treatment deemed necessary if the student is injured or requires medical attention during the student's participation in the activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation and for any follow up care arising from such treatment in order to prevent infection or other complications and harm. I hereby release, forever discharge and hold harmless Hollis Artspace LLC from any claim based on such treatment or medical services.

2.     Copyright protection:

Occasionally Hollis Artspace might use Student Content for marketing, social media, or other purposes. I hereby irrevocably grant Hollis Artspace LLC permission to use the following in any and all of its publications, including web-based publications (collectively “Student Content”):

                               i.       Artwork I produce during classes or workshops

                               ii.     Images of artwork I produce during classes or workshops

                               iii.     Comments left on the Hollis Artspace website or otherwise provided in writing to Hollis Artspace LLC.

I further irrevocably authorize Hollis Artspace to edit, alter, copy, exhibit, publish, or distribute the Student Content for any lawful purpose. In addition, I waive any right to inspect or approve the use, display or alterations of the Student Content. Additionally, I waive any right to royalties or other compensation arising or related to the use of the Student Content.

 I hereby hold harmless, release, and forever discharge Hollis Artspace LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

3.     Model/ Photo release: 

Occasionally Hollis Artspace might use the participant’s likeness for marketing, social media, or other purposes. I hereby irrevocably grant Hollis Artspace permission to use the participant’s likeness in a photograph, video, or other digital media (collectively, “photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of Hollis Artspace and will not be returned.

I further irrevocably authorize Hollis Artspace to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

I hereby hold harmless, release, and forever discharge Hollis Artspace LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

4.     Liability Waiver:

Acknowledgment of Risk

Hollis Artspace LLC offer artistic activities, which primarily happen indoors but occasionally outdoors.  I, as the participant and/or in my legal capacity as the parent/guardian of the minor participant named below, do hereby acknowledge and agree that participation in HOLLIS ARTSPACE, LLC is voluntary. I have full knowledge and understanding of the risk associated with Hollis Artspace, LLC, including but in no way limited to: (1) slips, trips, and falls, (2) cuts or burns, (3) illness, including exposure to and infection with viruses or bacteria, and (4) exposure to odors and fumes in connection with paints and other materials used in the class or workshop. I further acknowledge that the preceding list is not inclusive of all possible risks associated with Hollis Artspace’s programs participation and that said list in no way limits the operation of this Agreement. 

 

5.     Waiver, Release of Liability, & Indemnification:

By checking this form I agree that the named participant, for themself and on behalf of their heirs, assigns, personal representatives and next of kin, hereby releases and holds harmless, Hollis Artspace, LLC or Swamp Frogs, LLC,  any teachers, volunteers, employees, and if applicable, owners, renters and lessors of premises used to conduct any event with respect to any and all injuries, illnesses, disabilities, loss of life or damage to person or property occurring or arising out of participation in the program, now and in the future. 

I certify that the participant is in good health and has no conditions or impairments which would preclude their safe participation in classes, workshops, and other activities at Hollis Artspace.  I further certify that I am of lawful age (18 years or older) and legally competent to sign this agreement, and/or I have legal capacity to act as the parent/guardian of the minor participant.
